Agreement to Terms

By accessing or using OurBotBuilder.com ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Definitions

• "You" refers to the individual or entity using the Service
• "Chatbot" refers to the AI-powered conversational agents you create
• "Content" refers to documents, URLs, and data you upload
• "End Users" refers to visitors who interact with your chatbots

Account Registration

To use the Service, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Be at least 13 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into contracts
• Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

Subscription Plans & Billing

Plans

• Free Tier: 1 chatbot, 500 messages/month
• Pro Plan: 5 chatbots, 5,000 messages/month
• Business Plan: 20 chatbots, 25,000 messages/month
• Agency Plan: Unlimited chatbots, 100,000 messages/month

Billing

• Subscriptions are billed monthly in advance
• All payments are processed securely through Square
• Prices are subject to change with 30 days notice
• No refunds for partial months or unused messages
• Failed payments may result in service suspension

Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. You will retain access until the end of the paid period.

Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any laws, regulations, or third-party rights
• Upload illegal, harmful, or offensive content
• Impersonate others or provide false information
• Spread malware, viruses, or malicious code
• Engage in fraudulent, deceptive, or manipulative practices
• Spam, harass, or abuse others
• Scrape, mine, or extract data without authorization
• Reverse engineer or attempt to access source code
• Overload or disrupt our systems
• Resell or redistribute the Service without permission

Content & Intellectual Property

Your Content

• You retain all rights to content you upload
• You grant us a license to use your content to provide the Service
• You are responsible for ensuring you have rights to uploaded content
• You warrant that your content does not infringe on third-party rights

Our Platform

The OurBotBuilder.com platform, including all software, code, designs, trademarks, and documentation, is our exclusive property. You may not copy, modify, distribute, or create derivative works without written permission.

AI Processing & Third-Party Services

Our Service uses OpenAI's API to generate chatbot responses. By using the Service, you acknowledge:

• AI responses may not always be accurate or appropriate
• You are responsible for monitoring and controlling your chatbot's responses
• Data is processed by third-party AI providers subject to their terms
• We are not liable for AI-generated content

Data & Privacy

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE SERVICE
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES (OpenAI, Square, etc.)

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your content or chatbots
• Your violation of these Terms
• Your violation of third-party rights

Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Request account deletion

Upon termination, your access will be revoked, and your data may be deleted after 30 days.

Changes to Terms

We may modify these Terms at any time. Significant changes will be notified via email or platform notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law & Disputes

These Terms are governed by the laws of California, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
